Competition analysis
On the information available to the ACCC, there appeared to be no significant overlap between the products supplied by Nestle and Novartis in Australia. Even if a national market for the supply of milk modifiers was adopted, the proposed acquisition was unlikely to substantially lessen competition particularly given the small increase in Nestle Australia's market share post-acquisition.
