Guidelines relating to deferral of arbitrations and backdating of determinations under Part IIIA of the Trade Practices Act 1974

Part IIIA of the Trade Practices Act 1974 (the Act) is a key component of the regulatory framework supporting the development of a competitive environment in markets associated with the operation of certain infrastructure facilities.

Effective from 1 October 2006 the Trade Practices Amendment (National Access Regime) Act 2006 amended Part IIIA.

The purpose of these guidelines is to explain how the ACCC might apply the provisions on deferral of arbitrations and backdating of final determinations when making decisions under Part IIIA.

The ACCC released on 30 March 2007 a final set of guidelines following this public consulation process.
