On 27 November 2006 the ACCC decided not to oppose the acquisition after accepting court-enforceable undertakings from Alinta addressing the competition concerns that had been raised.
On 11 October the ACCC advised Origin that it had serious competition concerns and an undertaking would be required to prevent this transaction being opposed. On 27 November 2006 AGL was announced as the winning bidder in the sale of Sun Gas and negotiations regarding an undertaking from Origin were discontinued.
