Market definition
The ACCC considered the following markets in its review of Visy's acquisitions:
- A South East Queensland market for the receipt, handling, processing and disposal of dry recyclable material, including paper, plastics and glass (DRM).
- A South East Queensland (or Queensland) market for colour sorting small glass particles (glass particles smaller than 60 millimetres).
- A Queensland market for the supply of all sized colour sorted glass particles to end users in the manufacture of glass packaging.
- A Queensland market for the supply of recyclable paper for end-use in recycled paper products.
Competition analysis
The ACCC considers that Visy faces sufficient competitive constraints post-acquisition and that the acquisition is unlikely to have caused a substantial lessening of competition in any of the relevant markets. This conclusion is informed by the following factors:
- Significant countervailing power on the part of the councils and, to a lesser extent, end-users of recyclable glass.
- Availability of substitutes for recyclable glass and recyclable paper.
- A number of other waste management service providers who can provide recyclable material processing and operation of MRF services.
- Moderate barriers for entry into the market for the receipt, handling, processing and disposal of DRM.
