Consultation and competition notices—wholesale line rental pricing

In December 2005 the ACCC issued a consultation notice to Telstra relating to its pricing of its wholesale line rental products.

In April 2006 the ACCC issued a Part A competition notice to Telstra under subs. 151AKA(2) of the Trade Practices Act 1974. The ACCC issued the notice because it had reason to believe that Telstra had engaged, and was engaging, in at least one instance of anti-competitive conduct relating to Telstra's pricing of its wholesale local services products.

In May 2006 Telstra challenged the validity of the competition and consultation notices in the Federal Court of Australia on a wide variety of grounds.

On 28 February 2007 the ACCC revoked the competition notice. A news release explaining the revocation decision was released on 2 March 2007.

In April 2007 Justice Bennett found that the ACCC was not entitled to issue the competition notice. The ACCC issued a news release in relation to this decision on 5 April 2007.
