Issues in the ACCC merger guidelines

Summary

Since the merger guidelines were issued in June 1999, there has been considerable advance both in the Australian experience of mergers under the Trade Practices Act and in the economic analysis of mergers. The ACCC has recently commenced the process of revising the merger guidelines to bring them up to world best practice. This paper considers some preliminary ideas on the issues of market definition, market concentration, barriers to entry and countervailling power.
