Further submissions received by the ACCC in the ULLS undertaking assessment

The submissions on this page have been received by the ACCC in relation to Telstra's Dec 2005 ULLS monthly charge undertaking. Certain of these submissions were received before the ACCC's deadline for submissions of 21 July 2006, while certain submissions were provided after 21 July 2006.

Submissions received before 21 July

The ACCC received the following submissions from parties before 21 July:

  • Optus, Response to report on the appropriate WACC for the ULLS network, 12 Apr 06.
  • Optus, Telstra's network modernisation clause, Jul 06.
  • Network strategies, An accurate assessment of the comparative costs of wireless access technologies in Australia, 7 Jul 06.
  • CCC, Submission in response to Telstra undertakings for the ULLS, 7 Jul 06.
  • Austar, Response to the ACCC's draft decision on Telstra's ULLS monthly charge undertaking, 18 Jul 06.

In addition to the two Optus papers listed above, Optus also submitted the following documents to the ACCC before 21 July for consideration in the ACCC's final decision:

  • Optus, Telstra's PIE II model, May 06.
  • Optus, The interaction between retail pricing parity obligations and deaveraged ULLS pricing, Feb 06.
  • NERA, Assessment of the PIE II model - a report for Optus, Jul 03.
  • NERA, Comments on PSTN conveyance costs in PIE II - a report for Singtel Optus, Mar 04.
  • NERA, Role of TSLRIC in telecommunications regulation - a report for Optus, Jul 03.

Optus has stated that these five documents contain confidential information of both itself and Telstra. It has stated that it will provide the confidential documents to parties who have signed appropriate confidentiality undertakings with itself and Telstra. Submissions received after 21 July

The ACCC received the following public submissions from parties after 21 July:

  • Optus, ACCC draft decision on ULLS monthly charge undertaking, Jul 06.
  • Optus (Frontier economics), Telstra's ULLS undertaking—impact of average ULLS charges on promotion of competition, Jul 06.

The ACCC also received three submissions provided by Mr Derek Francis in final form on 9 August 2006 on behalf of a group supporting telecommunications deregulation:

Telstra submitted numerous confidential documents to the ACCC's assessment of Telstra's ULLS undertaking, after 21 July. Telstra undertook to provide public versions of the majority of these documents, but is yet to provide a large number of the public versions. The ACCC has published the public versions of documents that it has received. A list of documents for which Telstra undertook to provide public versions, but has yet to do so, is available below.

Optus also provided two confidential submissions to the ACCC after 21 July—a supplementary submission concerning ULLS price averaging (11 Aug 06) and a response to Telstra's post-21 July submissions (Aug 06).
