Merger review process guidelines July 2006

The Merger Review Process Guidelines (the process guidelines) supplement the Merger Guidelines 2008 by providing a reliable, comprehensive and detailed guide to merger parties, the business community, their advisers and the public that they can draw on to predict the processes that will be applied by the ACCC to merger reviews. It reflects the ACCC's commitment to the timely, consistent and transparent assessment of mergers while preserving the benefits of the informal system that has evolved over the years.

The process guidelines replace the Guideline for Informal Merger Review which was originally issued in October 2004.

While many of the processes outlined in the process guidelines have already been set in place, full implementation of the new processes will take effect from 1 July 2006.

This publication has been updated to refer to the Competition and Consumer Act 2010 which replaced the Trade Practices ACT 1974 on 1 January 2011. For more information on the Australian Consumer Law changes see www.consumerlaw.gov.au

Recent reforms to the Freedom of Information Act 1982 (the FOI Act) have necessitated amendments to the process guidelines. The ACCC has made some changes to the process guidelines, as contained in the following Addendum.
