ACCC institutes against H & Y Trading Pty Ltd over alleged fibre content misrepresentation

The Australian Competition and Consumer Commission has instituted legal proceedings against H & Y Trading Pty Ltd, alleging misleading and deceptive conduct in respect to the fibre content labelling of certain Aussiesox brand socks which it imports and distributes.

The ACCC alleges that H & Y Trading Pty Ltd represented a range of socks as 'Pure Cotton' when they were not composed entirely of cotton.

H & Y Trading Pty Ltd is also alleged to have misrepresented that a range of its ‘Cotton Rich’ socks was composed of 98 per cent cotton when they were composed of no more than 84.8 per cent cotton.

The ACCC is seeking:

  • declarations
  • injunctions
  • a publication order
  • a trade practices compliance program, and
  • costs.

A directions hearing has been set for 9:30am on 21 March 2006 in the Federal Court, Melbourne before Justice Heerey.
