ss. 52, 53(g) Alleged false or misleading representations about consumers' statutory rights in on-line mobile phone user manuals.

29 December 2005: Proceedings instituted in the Federal Court, Perth. Initial directions hearing (originally set down for 9 February 2006) now listed for 20 March 2006".

20 March 2006: At the directions hearing Siopis J ordered that on or before Wednesday 29 March 2006, the applicant and respondent file joint submissions in support of the final orders sought by the parties.  The joint submissions were filed and the matter is now awaiting judgment.

29 May 2006: Directions hearing as to final orders.

4 July 2006: The Federal Court found that LG Electronics Australia Pty Ltd had made false or misleading representations in several of its online mobile telephone user manuals about the existence and duration of statutory conditions and warranties implied by the Act, and also about the rights and remedies that were available to mobile telephone owners/consumers. By consent the Court ordered:

  • declarations
  • injunctions
  • a review of the existing trade practices compliance program
  • corrective notices
  • costs.
