Public disclosure of record-keeping rule information received from Australia Post
The record-keeping rule provisions contained in the Australian Postal Corporation Act 1989 allow the ACCC to publish reports analysing the information that is provided under the record-keeping rules. Such reports may include information that Australia Post claims is commercial-in-confidence if the ACCC is satisfied:
that the claim is not justified, or
that it is in the public interest to publish the information.
Following consultation with Australia Post and other interested parties, the ACCC has Principles for the public disclosure record-keeping rule information provided by Australia Post to provide guideance as to how it will apply these tests.
This report outlines the principles that the Australian Competition and Consumer Commission (ACCC) will apply when considering whether to publicly disclose information that Australia Post claims is confidential.
