Summary
In November 2004 Fonterra lodged a submission in support of its request to the ACCC for informal clearance of its takeover offer for National Foods Limited.
The ACCC identified a number of competition concerns associated with the proposal. In response to these concerns, Fonterra proffered an undertaking to the ACCC that certain arrangements be entered into with an Approved purchaser. These undertakings were accepted by the ACCC.
