Professions & competition

By enforcing the Trade Practices Act, the ACCC provides for the protection of consumers in their dealings with professionals. Examples of different types of professions include:

  • health related: doctors, dentists, physiotherapists, podiatrists, pharmacists
  • non-health related: architects, engineers, veterinarians, surveyors, lawyers.
The ACCC has adopted the definition proposed by the Australian Council of Professions.

Changes in legislation to extend Part IV of the Trade Practices Act; The Hilmer Report; state and territory legislation.

Broad issues of concern across all professions; Types of restrictions on competition.

Legal proceedings; enforceable undertakings as an alternative to legal proceedings.

Price negotiation; Recommended fee scales; The role of associations.

The ACCC has recently joined professional/business advisers in an accessorial capacity to undertake legal proceedings for contraventions under the Trade Practices Act.

Medical rosters; Medical workforce issues; Credentialling rights at hospitals; RACS application for authorisation; RACGP authorisation on fee agreements.

Is the relationship between a professional and client a fiduciary one? Fiduciary obligations — incompatible with competition laws?

Potential anti-competitive or misleading practices in emerging professions.
