Proceedings instituted 28.10.02 in the Federal Court, Melbourne.

BMW Australia Limited has appealed a finding by Justice Marshall on 16.7.03 that it had breached the Act by supplying vehicle jacks and vehicle owner manuals between 1997 and 2002 that did not comply with the requirements of the mandatory consumer product safety standard for new vehicle jacks. The appeal was heard before Justices Gray, Weinberg and Goldberg in the Federal Court, Melbourne, on 16.12.03. The court has reserved its judgment.
