GO Drew Pty Ltd (the Company) has provided a section 87B Undertaking to the ACCC in relation to the use of a logo similar to the National Heart Foundation registered Smart Foods Tick Logo appearing on the labelling of two varieties of egg products supplied by the Company. The ACCC considered the labelling to be misleading in relation to the benefits, sponsorship or affiliation of those products and, as such, contravened sections 52, 53(c) and 53(d) of the Trade Practices Act 1974.
The Company has amended its labels and has undertaken not to repeat the conduct of concern and to implement a trade practices compliance program.
