7. What should a franchisee do if they were not given a disclosure document before they entered into the franchise agreement?

If the franchisee was not given a disclosure document at least 14 days before they:

  • entered into the franchise agreement or
  • made a non-refundable payment to the franchisor in connection with the franchise agreement

then the franchisor has breached the Franchising Code. The franchisee should consider seeking legal advice or contacting the ACCC.
