Legislation

The ACCC enforces the Competition and Consumer Act 2010 (on 1 January 2011 the Trade Practices Act 1974 was renamed the Competition and Consumer Act 2010). We do not maintain copies of this legislation on our website as it is maintained on both the ComLaw and AustLII websites. ComLaw, incorporating the Federal Register of Legislative Instruments (FRLI), is the legal information retrieval system owned by the Australian Attorney-General's Department, and AustLII is an educational site.

Exceptions under commonwealth, state & territory legislation


Some Commonwealth, state and territory Acts permit conduct that would normally contravene the Competition and Consumer Act. Section 51(1) of the Competition and Consumer Act provides that such conduct may be permitted if it is specifically authorised under those other Acts.
