Expiry dates for declared services

The ACCC has declared various services under s. 152AL(3) of the Trade Practices Act 1974 (now the Competition and Consumer Act 2010 (CCA)). The services descriptions for these services and their expiry dates are maintained on a public register.

The ACCC must set expiry dates for declarations and this should that occur between 3 and 5 years from the date a declaration is made unless in the Commission's opinion, there are circumstances that warrant the expiry date occurring in a shorter or longer period. Before then expiry of a declaration the ACCC must conduct a public inquiry to review whether each declaration should be extended, varied, renewed, revoked or allowed to expire.

Since the introduction of declarations there has been several changes to the requirements relating to expiry dates. The ACCC considered the issue of declaration expiry dates in 2003 in a review at that time.
