Part VIIA of the Competition and Consumer Act 2010

Part VIIA of the Competition and Consumer Act 2010 ('the Act') sets out the ACCC’s functions in relation to price inquiries, price notifications and price monitoring.

The ACCC currently has one main role under Part VIIA of the Act in relation to waterfront & shipping. The role is to monitor prices, costs and profits of container terminal operator companies at the ports of Adelaide, Brisbane, Burnie, Fremantle, Melbourne and Sydney. See container stevedoring.

The ACCC’s prices surveillance and monitoring work was previously performed under the Prices Surveillance Act 1983 but this was repealed on 1 March 2004.  

In relation to waterfront & shipping, the ACCC’s past work under Part VIIA of the Act has included:

  • Harbour towage—assessing price notifications from harbour towage companies, including Adsteam Marine Ltd. Harbour towage companies have not been declared since September 2002.
