Federal Court stops Pauls 'Local Milk' claims in the NT

Pauls Limited was last night ordered to temporarily stop making claims that it provided "local" milk in its current Northern Territory advertising campaign.

Justice O'Loughlin of the Federal Court ordered Pauls not to: represent that Pauls' milk products are "local milk"; and represent that Pauls' milk products are processed from raw milk only obtained from Brigalow Farms dairy in Katherine.

Undertakings were made to the court that Pauls will: henceforth cease distributing, and destroy all copies of, a poster entitled "The farm-fresh story of Pauls' milk"; and no longer make the claim that "Pauls Fresh Milk has been produced in the Territory for over 35 years".

The orders remain in place until the trial of the Australian Competition and Consumer Commission claims against Pauls is heard in full. At the final hearing the ACCC is seeking corrective advertising, permanent injunctions and refunds for consumers.
