The removal of self regulation in the advertising industry in 1997 placed a responsibility on anyone involved in advertising and promotion not to engage in misleading and deceptive conduct that breaches the Trade Practices Act. The August 1998 Federal Court decision in ACCC v Nissan Motor Company (Aust) Pty Ltd is a prime example of a company and its South Australian advertising agent failing to ensure compliance with the Act ... and paying the price.
