Submissions in response to the ACCC’s Initial Assessment
The Trade Marks Act and associated regulations requires the ACCC to make all written responses to its Initial Assessment available to the applicant and to each other person that made a written response. As a result, the ACCC intends to place all written responses it receives on its website. For this reason the ACCC is unable to accept confidential submissions in response to its Initial Assessment. Should interested parties not wish their written response to be made available to all interested people in this way, they have the option to withdraw their response – in which case it will not be taken into account in the ACCC’s assessment of this CTM application.
Submissions received prior to 2 November 2012, that is, prior to the ACCC’s Initial Assessment, are not required to be provided to other parties. Given the large volume of submissions received prior to the Initial Assessment and frequent concerns expressed by submitters regarding confidentiality, the ACCC does not propose to place these submissions on its website at this time.
