Southern Sydney Freight Line variation - 4 September 2012

On 4 September 2012 the Australian Rail Track Corporation (ARTC) submitted to the ACCC a proposed variation to the 2008 Interstate Access Undertaking (IAU). The proposed variation relates to the incorporation of the Southern Sydney Freight Line (SSFL) and applicable access charges into the IAU.

The ACCC is assessing whether to accept the proposed variation under Part IIIA of the Competition and Consumer Act 2010.


Consultation Paper

On 18 September 2012 the ACCC issued a Consultation Paper calling for submissions by interested parties. The Consultation Paper is available below and provides further information on how to make a submission and questions of particular interest to the ACCC. Submissions closed on 16 October 2012.

Submissions to the 18 September 2012 consultation paper

Draft Decision

On 6 February 2013 the ACCC issued a draft decision to consent to ARTC’s proposal to extend the coverage of its existing Interstate Access Undertaking to include the Southern Sydney Freight Line and associated Indicative Access Charge. The draft decision is available below.

The ACCC is calling for submissions on its draft decision by 22 February 2013. Details on making a submission to the ACCC are outlined in section 1.4 (p.9) of the draft decision. The ACCC will make a final decision on the proposal by April 2013.
