Schedule H forecast capital expenditure variation – 6 January 2012

Application to vary the 2008 Interstate Rail Access Undertaking - 6 January 2012

On 6 January 2012 ARTC submitted to the ACCC a request to vary its 2008 Interstate Rail Access Undertaking (Access Undertaking). This variation relates to proposed forecast capital expenditure applicable to the period 1 July 2012 to 30 June 2018 on the Interstate Network, as foreshadowed in section 2.4(c) of the Interstate Access Undertaking.

On 18 April 2012, the ACCC decided to consent to ARTC’s application to vary its Access Undertaking. The decision is available below.



In its decision, the ACCC has highlighted that ARTC's capital expenditure is more likely to be prudent if effective consultation has taken place during the development and implementation of its capital expenditure program. The ACCC has provided guidance on what it considers would constitute effective consultation.

The ACCC assessed whether to accept the proposed variation under Part IIIA of the Competition and Consumer Act 2010 (Cth). As part of its assessment the ACCC conducted a public consultation process.
 
On 25 January 2012 the ACCC issued a Consultation Paper calling for submissions by interested parties. The Consultation Paper is available below.
