The ACCC has made a short fiction film called The Marker to engage people at all levels of business about what cartel conduct involves and the devastating impact that cartels can have on participants. The Marker shows how cartels can ruin relationships, careers, reputations and long term financial security, and may ultimately land guilty parties in jail.
The ACCC has made The Marker partly in response to research conducted by the University of Melbourne Law School in 2010 that showed:
Over half of business people do not know that cartel conduct is a criminal offence; and
Despite being told the legal consequences, almost one in 10 business people would be likely to engage in cartel conduct if the opportunity presented itself.
It pays to take action. The first to report may gain immunity from prosecution.

Mr Sims wants everyone in business to know that breaking the law for short term gain is just not worth it – and if they’ve had any involvement in a cartel, the answer is to be the first member of the cartel to come to the ACCC and seek an immunity marker.
As a business leader Mr Joyce says cartels have no place in the legitimate business world. He highlights the destruction cartels cause to business and employees, and speaks directly to Qantas’ involvement in an international air cargo cartel.
