Current directions relating to the ACCC's role in airport regulation

The Australian Competition and Consumer Commission (ACCC) undertakes formal monitoring of aeronautical and car parking services at specified Australian airports in accordance with directions issued by the Assistant Treasurer under the Competition and Consumer Act 2010 (CCA).

The ACCC also undertakes assessments of the pricing of aeronautical services and facilities provided to regional air services at Sydney Kingsford Smith Airport in accordance with a declaration issued under the CCA. In undertaking its assessments, the ACCC must give special consideration to a direction issued by then Minister for Competition Policy and Consumer Affairs under the CCA.

The following sections set out the three directions relating to the ACCC’s role in airport regulation.


Aeronautical services at Australian airports

Pursuant to a direction made under section 95ZF of the CCA, the ACCC undertakes monitoring of the prices, costs and profits relating to the supply of aeronautical services and facilities at the following Australian airports:

  • Melbourne Tullamarine Airport
  • Brisbane Airport
  • Perth Airport
  • Sydney Kingsford Smith Airport


Car parking services at Australian airports

Pursuant to a direction made under section 95ZF of the CCA, the ACCC undertakes monitoring of the prices, costs and profits relating to the supply of car parking services at the following Australian airports:

  • Melbourne Tullamarine Airport
  • Brisbane Airport
  • Perth Airport
  • Sydney Kingsford Smith Airport


Regional air services at Sydney Airport

The provision of aeronautical services and facilities provided to regional air services at Sydney Kingsford Smith Airport are notified services pursuant to a declaration made under section 95X of the CCA. This means that Sydney Kingsford Smith Airport must provide a price notification to the ACCC prior to it increasing its prices for those services. 

In undertaking its assessment of price notifications provided by Sydney Kingsford Smith Airport, the ACCC gives special consideration to the Government’s policy outlined in a direction made under section 95ZH of the CCA. The Government’s policy states that, to facilitate continuing access to Sydney Kingsford Smith Airport by operators of regional air services, the total revenue-weighted percentage increase in prices over three years from 1 July 2010, or part thereof, should not exceed the total percentage increase in the Consumer Price Index over that same period.
