Description of Conduct

On 21 December 2011, Hunter Resource Recovery lodged an application for authorisation for a tender process under which HRR will invite tenders on behalf of the Cessnock City Council, Lake Macquarie City Council, Maitland City Council and Singleton Council (the Councils) for a joint recycling contract for the collection, sorting and disposal of dry recyclables collected from residential and commercial clients of the Councils. HRR proposes that a single tenderer will be selected by the Councils through the collective tender process. HRR will contract with the successful tenderer as delegate and trustee of the Councils for a period of 10 years with the option of 2x1 year extensions.

On 25 January the ACCC granted interim authorisation. Interim authorisation commenced immediately and remained in place until the date that the ACCC's final determination came into effect.

On 1 March 2012, the ACCC issued a draft determination proposing to grant authorisation in respect of the proposed arrangements for twelve years.

On 12 April 2012 the ACCC authorised the conduct for 12 years (until 4 May 2024) and released its final determination.
