On 16 December 2011, the ACCC commenced an inquiry into declaration of wholesale ADSL services under section 152AL of the Competition and Consumer Act 2010(Cth).
The ACCC issued a discussion paper inviting submissions on whether declaration of wholesale ADSL services would promote the long-term interests of end-users. The discussion paper and submissions can be found below.
On 14 February 2012, the ACCC decided to declare the wholesale ADSL service under section 152AL(3) of the Competition and Consumer Act 2010 (Cth). The reasons for the ACCC's decisions can be found below.
On the same day, the ACCC decided to commence an inquiry under Part 25 of the Telecommunications Act 1997 (Cth) into the making of a final access determination for the declared wholesale ADSL servie under section 152BC(1) of the Competition and Consumer Act 2010 (Cth). The ACCC also made an interim access determination (IAD) regarding access to the wholesale ADSL service under section 152BCG of the Competition and Consumer Act 2010 (Cth). The IAD and accompanying statement of reasons can be found below.
