Dangerous consumer products (or related services) can be banned.
There are 2 types of bans:
- an interim ban: may be imposed by a State, Territory, or Commonwealth minister. The duration of these bans may be 60–120 days.
- a permanent ban: may be imposed by the Commonwealth minister. The ban will operate until it is revoked.
It is an offence for a business to supply, or offer to supply, banned products or services, or to manufacture, possess or control banned products for the purpose of supply. This can lead to a penalty of up to the greater of $10 million, 3 times the value of the benefit received, or where the benefit cannot be calculated, 10% of annual turnover in the preceding 12 months for corporations, or $500,000 for individuals.
